TERMS:
Buyer premium of 12%. All items sold as is and where is.
INSPECTION:
All auction items are available for inspection. Buyers are encouraged to inspect all items to be sold during preview time. Bidders, including absentee bidders, are responsible for making their own decisions. If you have not previewed the item, we recommend you do not bid.
REGISTRATION:
In order to bid, the buyer must register. To register, the bidder must sign up on the web page and fill out the information.
ALL SALES FINAL ? NO RETURNS: It is up to the (bidder) buyer to inspect the item(s) prior to the sale. All bidding and purchases are at the buyer?s discretion. Absentee bidders / buyers are subject to these terms. All the merchandise is sold “as is”. There are no warranties expressed or implied. Neither Drumm’s Antiques nor the consignor makes any guarantee or warranty as to the authenticity, nor shall any description (oral or written) of condition, size, quality, rarity, importance and / or provenance be deemed a guarantee.
BIDDING: The auctioneer maintains the right to accept or reject any bids and reserves the right to pass any item(s) for which a reasonable starting bid is not made.
PAYMENT BY ABSENTEE BIDDERS: Absentee bidders will be given a minimal amount of time to submit their payment by cash, money order or credit card.
For Live Auctions Only: ABSENTEE, LEFT & TELEPHONE BIDS: Absentee bids and telephone bids are accepted at the discretion of Drumm’s Antiques and are subject to the Terms of Sale. You must be registered and agree to the terms. Drumm’s Antiques will execute absentee bids competitively and as a convenience, and is not responsible for errors or failure to execute bids. The successful absentee or telephone bidder is responsible for the purchase price, the buyer?s premium, applicable taxes, plus shipping, handling, and insurance if required. Payment if by cash, check or money order must be postmarked within five business days from the date of the auction, following notification of successful absentee bids. Notification is by telephone or email within two business days after the auction. Purchases must be picked up within five days of notification or be subject to a storage fee of $10.00 per day, per item. There is no return privilege.
CONFLICTS TO ABSENTEE, LEFT & TELEPHONE BIDS: If left bids are equal, the first left will be executed.
DISPUTED BID: or reopen the bidding on the item in question at his discretion. It is up to the bidder to display his / her number clearly to the auctioneer. The auctioneer will not be responsible for overlooked or late bids.
BUYER?S PREMIUM: There is a 12% ?Buyer?s Premium?. Auction flyers, emails, auctioneer, etc. may advertise this. The buyer?s premium is to be paid in addition to the purchase price. Drumm’s Antiques reserves the right make any changes to the buyer?s premium.
PAYMENT: Payment is required on the day of sale. We accept cash, known business or personal checks, Master Card, Visa, (Discover and American Express for OnLine Auctions only). When paying by check, the check must be dated and bankable the day of purchase. Identification will be required.
CALIFORNIA SALES TAX: Drumm’s Antiques is required by the State of California to collect applicable sales tax from buyers. The tax is calculated on the total purchase price, i.e. hammer price plus buyer?s premium. Dealers with a valid Resale Certificate filed with Drumm’s Antiques and out-of-state buyers whose purchases are being shipped out-of-state, are exempt from paying CA sales tax. All out-of-state residents who attend the sale must pay CA sales tax.
PURCHASED GOODS REMOVAL & RESPONSIBILITY: All items purchased at auction become the property and responsibility of the buyer once the item is sold. The buyer shall immediately assume full risk and responsibility of the lot. Our staff will either hand the buyer the lot or place it in a convenient location. It is advisable that buyers take possession of purchased items and remove them as soon as possible. All purchases must be removed the same day unless previous arrangements have been made. Items left by buyers are the sole responsibility of the buyer. Drumm’s Antiques assumes no liability whatsoever for any items after the item is ?sold? by the auctioneer. Assistance in removing items can be obtained only after the auction has ended.
